1. EmailCash Prize Draw Official Rules
These official rules (the "Rules") apply to prize draws conducted by the "Promoter", EmailCash Marketing Pty Limited (ABN 26 119 988 519) of Suite G1, 221 Miller Street, North Sydney NSW 2060 (EmailCash Marketing Pty Ltd). The Competition "Chance to Win $10,000 with EmailCash" will be promoted on the EmailCash website, http://www.emailcash.com.au (the "Site") from the Monday, 16 June 2008, the day the promotion commences.
2. Rules
Information on the prizes and how to enter form part of these Rules. Participation in this promotion is deemed acceptance of these Rules.
3. Eligibility
3.1 The Prize draw is open only to registered members of EmailCash who remain active members during the promotional period and who comply with all the EmailCash Terms and Conditions of membership.
3.2 Each occasion that a member shops through EmailCash Reward Partners and has their claim for EmailCash reward points approved, they will automatically be issued with two entries into the competition.
3.3 Each occasion that a member clicks on a permission email message ("Reward Mail") sent by EmailCash, the member will automatically be issued with one entry into the competition.
3.4 Each occasion that a member participates in a survey sent by EmailCash, the member will automatically be issued with one entry into the competition.
3.5 Employees and immediate families of The Promoter and its agencies associated with this promotion are ineligible to win this competition.
3.6 EmailCash reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Conditions of Entry.
3.7 In order to claim the prize, the winner must provide EmailCash with a suitable testimonial (of no less than 50 words) and a suitable digital image of themselves that the Promoter may use for marketing and promotional purposes in both print and online media at its own discretion.
4. Promotional Period
4.1 The promotion commences at 00:00 AEST on 16 June 2008.
4.2 The promotion closes at 15:59 AEST on 30 September 2008.
5. Number of Draws: 1 in total.
6. Method for Drawing the Winners: Random Barrel Draw.
7. Prize Pool Value: $10,000.00 (1 X $10,000 cheque)
8. Winners Cheque: A cheque for $10,000 will be made out in the name of the first randomly drawn winner. The cheque will be posted to the winner's address as indicated in their EmailCash membership account as at the time of the draw.
9. Draw Dates and Times
The draw to determine the winner will take place at 11:00 AEST on Thursday, 2 October 2008.
10. Draw Venue
The venue for the draw will be the offices of The Promoter, Suite G1, 221 Miller Street, North Sydney, NSW, 2060, Australia.
11. Validity of Entries
11.1 Valid entries for the prize draw will be those entries received between 00:00 AEST on 16 June 2008 and 15:59 AEST on 30 September 2008.
11.2 The Promoter's decision is final and no correspondence will be entered into.
12. Winner Notification and Prize Redemption
12.1 The winner will be notified by email on Monday, 6 October 2008 via the email address that is currently registered in their EmailCash account.
12.2 The winner's details will be published on the EmailCash website on the Thursday, 9 October 2008.
12.3 The winner's details will be published in "The Australian" newspaper on Thursday, 9 October 2008.
12.4 All delivery/postage costs associated with the prize are the responsibility of The Promoter.
12.5 The winner must redeem the prize by cashing the cheque within 3 months of the relevant draw date.
12.6 A draw for an unclaimed prize may take place as per the legal requirements at least three months after the draw at 11:00 AEDST on Monday, 5 January 2009 at the same place as the original draw, subject to any directions from a regulatory authority.
12.7 If an unclaimed prize draw is required, the unclaimed prize draw winner will be notified via email on Wednesday, 7 January 2009.
12.8 If an unclaimed prize draw is required, the unclaimed prize draw winner's details will be published in "The Australian" newspaper on Monday, 12 January 2009.
13. Promoter Indemnification
13.1 Except for any liability that cannot be excluded by law, The Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under The Promoter's control); (b) any theft, unauthorised access or third party interference.
13.2 All entries become the property of The Promoter. Entrants consent to The Promoter using the entrant's name, likeness, image and/or voice (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by The Promoter.
13.3 The Promoter shall not be liable for any tax implications that may arise as a result of the prize. Independent financial advice should be sought.
13.4 The Promoter is not responsible for any incorrect or inaccurate information, whether caused by the Site’s users or by any of the equipment or programming associated with or utilised in this competition, or by any technical or human error that may occur in the course of the administration of this competition. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, computer viruses, bugs, unauthorised intervention, fraud, technical failures, theft or destruction or unauthorised access to or alteration of entries. Any cost associated with accessing the promotional website is the entrant's responsibility and is dependent on the Internet service provider used. The use of any automated software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
13.5 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any cause beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
